Please read these Terms and Conditions ("Terms") carefully before using the www.mlvmobility.com website (the "Website") operated by Eco Scooters Bassetlaw Ltd. T/A MLV Mobility ("us", "we", or "our").


Your access to and use of the Website is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Website or purchase products from us. By accessing the Website or placing an order, you agree to be bound by these Terms.


1. Definitions


  • "Customer," "You," "Your": The person using our Website or purchasing Products.

  • "Product(s)": Any mobility scooter, powerchair, rise and recline chair, or other item offered for sale on our Website.

  • "Contract": The legally binding agreement between you and us for the sale of Products.

  • "Order": Your offer to purchase a Product from us.

  • All content on this Website, including text, graphics, logos, and images, is the property of MLV Mobility and is protected by UK and international copyright laws. You may not reproduce, modify, or distribute any content without our prior written consent.

  • We strive to ensure all information on the Website is accurate. However, we do not guarantee that the information (including Product descriptions and pricing) is error-free, complete, or current. We reserve the right to correct any errors and to change or update information at any time without prior notice.


4. Product Sales


4.1. Product Descriptions 

Product images are for illustrative purposes only. While we aim to display colours accurately, we cannot guarantee that your device's display reflects the true colour of the Product. Specifications may vary slightly from those stated.


4.2. Pricing and VAT Relief

  • All prices are shown in Pounds Sterling (£) and are inclusive of VAT where applicable.

  • Many of our Products are eligible for VAT relief if the person using the item is "chronically sick or disabled." To claim VAT relief, you must provide a declaration of eligibility at checkout. It is your responsibility to ensure you meet the criteria set out by HMRC. Providing a false declaration is an offence. If you are unsure, you should seek guidance from HMRC or a medical professional.


4.3. Ordering and Contract Formation

  • Your completion of the checkout process constitutes an Order, which is an offer to buy the Products.

  • Our acceptance of your Order, and the formation of a legally binding Contract, occurs when we dispatch the Products to you. We will send you an email confirming dispatch.

  • We reserve the right to refuse or cancel any Order at our discretion, for reasons including but not limited to: stock unavailability, pricing errors, or suspicion of fraudulent activity.


4.4. Payment 

Payment must be made in full at the time of ordering through our accepted payment methods. Products will not be dispatched until cleared payment has been received.


5. Delivery


  • Delivery is available to UK mainland addresses. Additional charges may apply for other areas.

  • Delivery times are estimates and cannot be guaranteed. We are not liable for any delays caused by circumstances outside of our reasonable control.

  • It is your responsibility to ensure that someone is available at the delivery address to receive the Products. If delivery fails, a redelivery charge may be applied.


6. Cancellations, Returns, and Refunds


6.1. Your Right to Cancel (Cooling-Off Period) In accordance with the Consumer Contracts Regulations 2013, you have the right to cancel your Contract within 14 days without giving any reason. The cancellation period will expire 14 days from the day on which you (or a third party nominated by you) acquire physical possession of the goods.


6.2. How to Cancel To exercise the right to cancel, you must inform us of your decision by a clear statement (e.g., a letter sent by post or an email). You may use the model cancellation form available from us, but it is not obligatory.


6.3. Returning Goods

  • You must return the Products to us without undue delay and in any event not later than 14 days from the day you communicate your cancellation.

  • You will have to bear the direct cost of returning the goods. The cost is estimated at a maximum of approximately [£100-£150] for larger items like scooters, but may vary.

  • You are responsible for the Products until they are received by us. We recommend using a tracked and insured service.

  • You have a legal obligation to take reasonable care of the Products while they are in your possession. We may make a deduction from your refund for any loss in value of the goods supplied if the loss is the result of unnecessary handling by you.


6.4. Exceptions to the Right to Cancel The right to cancel does not apply to Products that are made to your specifications or are clearly personalised (e.g., bespoke or prescriptive powerchairs and rise and recline chairs).


6.5. Refunds If you cancel your Contract, we will reimburse all payments received from you, including the costs of initial delivery (except for supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). We will make the reimbursement without undue delay, and not later than 14 days after we receive the returned goods.


7. Home Assessments and Advice 


Where we provide a home assessment, the advice given by our specialists is based on the information you provide and their professional experience. It is intended to help you choose a suitable product but does not constitute a formal clinical or medical diagnosis.


8. Warranty 


All new Products are supplied with a manufacturer’s warranty. The duration and terms of the warranty vary by product and manufacturer. Full details will be provided with your Product. This warranty does not affect your statutory rights.


9. Limitation of Liability 


Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any matter for which it would be illegal for us to exclude our liability.


10. Governing Law and Jurisdiction 


These Terms and any Contract between us are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.


11. Changes to These Terms 


We reserve the right to modify these Terms at any time. Any changes will be posted on this page and will apply to all subsequent orders.
